User Service Agreement

Universal AI Voice Translate (hereinafter referred to as "this Software") is a professional tool for recording, translation and AI language services.
This User Service Agreement (hereinafter referred to as "this Agreement") is a legal contract concluded between you (hereinafter referred to as "User") and the service provider of this Software (hereinafter referred to as "we") regarding your downloading, installation, access and use of this Software and related services. Please read and fully understand all terms carefully before use, especially pay attention to the liability limitation, disclaimer and dispute resolution methods (relevant terms are marked in bold). If you are under 18 years old, you must read and confirm this Agreement accompanied by your legal guardian.
Your performance of any of the following acts shall be deemed as your full reading, understanding and agreement to all the terms of this Agreement:
1.Downloading and installing this Software;
2.Launching this Software or using any of its functions. If you do not agree to any content of this Agreement, please immediately stop downloading, installing or using this Software.
The formation, entry into force, performance, interpretation and dispute resolution of this Agreement shall all be governed by the laws of the mainland of the People's Republic of China (excluding conflict of laws rules). Any dispute arising from or in connection with this Agreement shall first be resolved by both parties through friendly negotiation. If negotiation fails, either party has the right to file a lawsuit with the people's court where the defendant is located.
We may update the content of this Agreement in accordance with business adjustments, revisions of laws and regulations or technological upgrades. The updated agreement will be published on the "Settings - User Terms" page of this Software. Your continued use of this Software after the agreement update shall be deemed as your acceptance of all revised terms. If you do not agree to the updated content, you shall immediately stop using this Software.
When using this Software, you must comply with the laws and regulations of the People's Republic of China and public order and good customs, and bear full responsibility for your own conduct and the resulting consequences. Specifically, you shall comply with the following requirements:
1.You shall independently bear responsibility for all content recorded, generated and stored through this Software (including recording files, photo translation results, text translation results and AI translation texts, hereinafter referred to as "User Content"). You shall ensure that you have obtained all legal rights or third-party authorizations for processing such content.
2.When using this Software (including but not limited to uploading text, audio, etc. to this Software, sharing service content, initiating any requests, etc.), you must commit to complying with the seven bottom-line requirements including laws and regulations, the socialist system, national interests, legitimate rights and interests of citizens, public order, social morality and information authenticity. You shall not include illegal and inappropriate information in the materials, nor shall you engage in the following acts, nor guide AI to generate and disseminate inappropriate content. Otherwise, we have the right to take measures such as refusing refunds (if any) and suspending services. All legal liabilities arising therefrom shall be borne by you:(1) Opposing the basic principles established by the Constitution;(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;(3) Damaging national honor and interests;(4) Distorting, defaming, profaning or denying the deeds and spirits of heroes and martyrs, or infringing upon the names, portraits, reputations and honors of heroes and martyrs by means of insult, defamation or other means;(5) Advocating terrorism, extremism or inciting the commission of terrorist or extremist activities;(6) Inciting ethnic hatred and discrimination, and undermining ethnic unity;(7) Undermining the state's religious policies and advocating cults and feudal superstitions;(8) Fabricating and spreading rumors and false information to disrupt economic and social order;(9) Disseminating obscene, pornographic, gambling, violent, murderous, terrifying content or abetting crimes;(10) Insulting, offending, abusing, belittling, provoking disputes, defaming others, or infringing upon others' reputation, privacy and other legitimate rights and interests;(11) Endangering network security and using the network to harm national security, honor and interests;(12) Intentionally evading technical review to publish inappropriate information, or guiding AI to generate inappropriate information or disseminating such information;(13) Making violent threats or intimidation against others, or conducting doxxing;(14) Involving others' privacy, personal information or data;(15) Disseminating vulgar language that damages public order and good customs;(16) Infringing upon others' legitimate rights and interests such as the right to privacy, right to reputation, portrait right and intellectual property rights;(17) Disseminating commercial advertisements, or similar commercial solicitation information, excessive marketing information and spam;(18) Infringing upon the legitimate rights and interests of minors or damaging the physical and mental health of minors;(19) Secretly photographing or recording others without their permission, and infringing upon others' legitimate rights;(20) Advocating discrimination and hatred, taking advantage of any vulnerabilities of specific groups based on their age, social, physical or mental characteristics, substantially distorting the behavior of people belonging to such groups, causing or possibly causing physical or psychological harm to such persons or others, including but not limited to civil discrimination, religious discrimination, nationality discrimination, gender discrimination, sexual orientation discrimination, age discrimination, occupation discrimination, health discrimination and regional discrimination;(21) Containing false, harmful, terrifying, violent and bloody, vulgar, infringing or other morally offensive content that affects others' physical and mental health and is not suitable for the physical and mental health of Youdao Dictionary user groups;(22) Other acts that violate laws, administrative regulations, policies and public order and good customs, or infringe upon the legitimate rights and interests of other users or third parties.
1.You shall not perform any act that affects the normal operation of this Software and related networks, including but not limited to: launching network attacks on the servers of this Software, profiting from software vulnerabilities (such as forging payment vouchers to obtain advanced functions), and using plug-in programs to tamper with recording or translation data;
2.You shall not hinder other users from using this Software normally, such as spreading virus-containing recording files through malicious sharing, occupying public network resources and causing delays in the response of others' functions.
If you violate these norms, we have the right to independently take the following measures according to the severity of the violation:
1.Restrict the use of some functions;
2.Clear illegal User Content in the device;
3.Terminate all services (without refunding the paid subscription fees, if any);
4.If your violation causes losses to us or third parties, we reserve the right to pursue your legal liability, and you shall bear all compensation liabilities (including litigation fees, attorney fees and compensation amounts).
You may only download and install this Software through the officially authorized channel of the Apple App Store. Versions of this Software obtained through unofficial channels (such as third-party cracking platforms and unauthorized app stores) will not be recognized by us. We have the right to take measures such as restricting functions, clearing local data and prohibiting the use of core services. All risks arising therefrom shall be borne by you.
The use of the core functions of this Software requires authorization of corresponding device permissions. The purposes and management methods of the permissions are as follows. You can independently adjust them through "Settings - Privacy & Security - Universal AI Voice Translate " on your iOS device:
1.Microphone permission: Used to record voice materials and provide original data for AI recognition and translation;
2.Storage permission: Used to save recording files, photo translation results, text translation results and AI translation results to the local device, without actively uploading them to our servers;
3.Camera permission: Used to take images of texts to be translated and provide original materials for the photo translation function.
1.You must have full capacity for civil conduct to use this Software independently. This Software is not specifically designed for minors under 14 years old, and minors of this age group are not allowed to use it;
2.If you are a person with limited capacity for civil conduct aged between 14 and 18, before using this Software (especially the paid functions), you must read this Agreement accompanied by your legal guardian and obtain the guardian's explicit consent to the following matters:Authorizing permissions such as microphone, camera and storage;Using functions such as AI translation, photo translation and text translation;Subscribing to paid services and paying fees;
3.Guardians shall be responsible for supervising minors' use of this Software, guiding them to operate correctly (such as avoiding recording others' privacy and misjudging translation results), and be liable for the consequences of use.
The use license granted to you by us is personal, non-transferable, non-sublicensable, non-exclusive and revocable, and is only for your non-commercial use on one mobile terminal (such as mobile phone and tablet) legally owned by you:
1.Installing and running this Software, and using all free functions;
2.If you subscribe to paid services, you can use the corresponding advanced functions during the subscription period, and the use is limited to personal use and shall not be sublicensed to others;
3.Recording voice, taking images of texts to be translated, performing text translation, generating AI translation results, storing such data locally on the device, which is only for personal use and does not infringe upon others' rights and interests.
During the use of this Software, you are prohibited from performing the following acts. Otherwise, we have the right to immediately terminate the license, take measures such as restricting functions, clearing relevant data and prohibiting the use of services, and will not refund the paid fees (if any):
1.Copying, modifying, renting, lending, selling, distributing this Software, or conducting decompilation, reverse engineering, disassembling codes (especially AI speech recognition algorithms, image recognition algorithms and text translation models), or creating derivative works;
2.Using this Software to engage in commercial activities;
3.Performing acts intended to damage or interfere with the operation of this Software and related networks.
The voice translation function of this Software is supported by ASR and APPLE technologies. The photo translation and text translation functions are provided with third-party technical services by Youdao and Volcano. When you use the above functions involving third parties, the relevant recognition and translation may call the cloud interfaces of third parties to complete the processing. All translation results are for reference only and do not guarantee complete accuracy.
In view of the fact that the core functions of this Software use AI technology, when you use AI-related functions (speech recognition, real-time translation, simultaneous interpretation), you shall additionally comply with the following agreements:
The accuracy of AI speech recognition may be affected by environmental noise (such as noisy venues), accents (such as minority dialects) and speaking speed, and deviations may exist. The accuracy of AI photo translation is affected by image clarity, light conditions, text layout and language types, and recognition errors or translation deviations may occur. AI text translation results are generated based on algorithms, and semantic deviations may exist for complex sentence structures, culture-specific expressions (such as proverbs and slang) and professional terms. They are for reference only and do not guarantee complete accuracy. In scenarios requiring high accuracy (such as legal texts, medical advice and business contracts), you shall verify the results manually.
In scenarios requiring high accuracy such as business negotiations and legal communications, you shall independently verify the authenticity and legality of the translation results. We shall not be liable for losses caused by AI deviations (such as decision-making mistakes and legal disputes).
AI recognition and translation are completed locally on your device throughout the process. Original audio, original images, text data, intermediate data and final results are all stored locally and will not be uploaded to our servers.
When it is necessary to transmit voice, images or texts to third-party cloud for processing, we will prompt you through pop-up windows or license authorization pages and seek your explicit consent when the function is used for the first time or every time it is called.
1.The intellectual property rights and related legitimate rights and interests of this Software and all the information and content contained therein (including text descriptions, graphical interfaces, audio materials, image recognition materials, AI algorithm codes, translation model data, trademarks, Logos and service marks) are owned by us or relevant right holders, and are protected by the Copyright Law of the People's Republic of China and the Trademark Law.
2.Without the explicit written authorization of us or relevant right holders, you shall not use, copy, modify, disseminate or display this Software and related content in any way, nor use trademarks or Logos identical or similar to those of this Software, nor confuse the public's perception of the source of services.
3.If you believe that the content in this Software infringes your intellectual property rights, please contact us through the contact information in this Agreement and submit the following materials:A copy of the ID card for individual users and a copy of the business license for enterprise users;Proof of intellectual property ownership (such as copyright registration certificate and trademark registration certificate);The specific location of the allegedly infringing content and an infringement description. We will verify it within 15 working days after receiving the materials. If it is indeed an infringement, we will take measures such as deleting the content and suspending relevant functions in accordance with the law.
We attach great importance to your personal information and privacy security. For details on how we collect, use, store and protect your personal information (such as device model, permission use records and local recording data), please read the Universal AI Voice Translate Privacy Policy carefully. This policy is an integral part of this Agreement and has the same legal effect as this Agreement. Your use of this Software shall be deemed as your simultaneous acceptance of all the terms of the Privacy Policy.
When you choose or authorize the use of third-party translation/recognition services (such as Youdao, DEEPSEEK/Volcano, ASR and APPLE), in addition to this Privacy Policy, you shall also comply with the privacy policies and use terms of the corresponding third-party service providers.
This Software provides paid subscription services. For relevant rules, please read the Auto-renewal Service Agreement carefully. Your subscription shall be deemed as your acceptance of all the terms of the Auto-renewal Service Agreement.
We may launch updated versions of this Software from time to time, including AI algorithm optimization, function addition and bug fixes. You can independently choose whether to install the update. If you refuse to update, some functions may not be available, and the losses shall be borne by you.
1.You can stop using this Software at any time. Before stopping, it is recommended to back up important data such as recordings and translation results stored locally on the device. After uninstalling this Software, all User Content in the device will be deleted and cannot be recovered;
2.We have the right to modify, suspend, interrupt or terminate the services according to the following circumstances:If you seriously violate this Agreement, we have the right to terminate the services immediately without refunding the paid fees;If this Software ceases operation, we will notify you through an announcement in the Software 30 days in advance, and you shall back up the data during this period. After the termination of operation, all services will be discontinued, and we have no obligation to retain or return any data.
1.If your violation of this Agreement or laws and regulations causes losses to us or third parties (including other users and regulatory authorities) (including direct losses, indirect losses, litigation fees, attorney fees and compensation amounts), you shall bear all compensation liabilities;
2.If a third party claims compensation or files a complaint against us due to your violation, you shall assist in handling it, protect us from such claims, and bear all expenses paid by us (such as litigation fees and compensation amounts).
1.We shall not be liable within the scope permitted by law for service interruption, data loss or function abnormality caused by reasons beyond our control such as force majeure, network anomalies, communication failures, system incompatibility and device hardware damage;
2.We are committed to providing stable services, but do not guarantee that the services meet all your needs, or are uninterrupted and error-free. You shall independently bear the responsibility for trusting and using the information obtained from this Software;
3.Your User Content is mainly stored locally on the device. It is recommended that you back up important data regularly. We shall not be liable for content deletion, storage failure or loss. After the termination of services, we have no obligation to retain or return any data.
4.We shall not be liable beyond the scope agreed in this Agreement within the scope permitted by law for recognition errors, translation deviations, delays, data leakage or other problems caused by recognition or translation services provided by third parties (including cloud processing, temporary storage, results returned by third-party models, etc.). If security or quality problems occur with third-party services, we will assist you in communicating with the third party to resolve the problem within our capabilities.
Within the scope permitted by law, we shall not be liable for the following losses:
1.Indirect losses, incidental losses, special losses or consequential losses;
2.Losses caused by your violation of this Agreement or risks borne by yourself;
3.If your direct losses are caused by our fault, the compensation amount shall not exceed the total amount of paid services you paid within 12 months before the incident. If you have not paid any fees, the maximum compensation shall be RMB 100.
1.Our failure to exercise any right under this Agreement shall not constitute a permanent waiver of such right, and we still have the right to exercise it as needed in the future;
2.If any clause of this Agreement is determined to be invalid or unenforceable, it shall not affect the legal effect of other clauses;
